These Terms & Conditions ("Terms") set out the agreement between you and Birdy Systems ("Birdy," "we," "us," or "our") for using our website and our services. By using our website or our services, you agree to these Terms.
Our services
Birdy provides business automation, client-retention, website design and development, and search engine optimization (SEO) services for small businesses. ChatGPT-powered advertising is available as a separate service, quoted and scoped on its own. The specific services you receive are described in your agreement with us. Billing, cancellation, and refunds
The Birdy package is billed monthly. There is no setup fee and no long-term contract. Monthly fees are non-refundable. You can cancel anytime before your next monthly renewal to stop future charges.
Prices are billed in Canadian dollars (CAD) for clients in Canada and US dollars (USD) for clients in the United States.
Payments are processed securely by Stripe. Birdy does not store card details.
ChatGPT-powered advertising, when you choose it, is quoted and billed separately on the terms we agree with you in writing.
No guarantee of specific results
Our systems are designed to help you save time, retain customers, and create more opportunities for new business. However, results depend on many factors, including your business, your market, and how the systems are used. We do not guarantee any specific number of reviews, leads, search rankings, customers, or revenue, and we do not promise that any particular outcome will occur.
Your responsibilities
When you use our website and services, you agree to:
- Provide accurate and complete information about your business.
- Use our services lawfully and in keeping with all applicable laws and regulations.
- Obtain and maintain any consent needed to contact your own customers, including consent for text messages, reviews, and follow-up communications.
- Be responsible for the content and accuracy of anything you publish or send.

We may use third-party services and platforms to deliver our services. We select and manage these on your behalf where relevant. We are not responsible for the actions, availability, or changes of third-party providers, and the performance of some services may depend on them.

You agree to use our website lawfully and not to misuse it, including not to disrupt it, attempt to gain unauthorized access, or use it to send unsolicited communications. We may change or remove parts of the website at any time without notice.
